These terms cover your use of xcoden.com. The site is run by Xcoden, LLC, a limited liability company in Chicago, Illinois ("Xcoden", "we", "us"). Using the site means you accept them.

This site is not a contract for work

Everything here — what we say we build, the work shown, the writing in Resources — is information about our practice. None of it is an offer, a quote or a commitment to take on a project, and nothing on this site creates a client relationship.

Work we do for a client runs on a separate signed agreement and statement of work. Where that agreement differs from this page, the agreement governs that work.

What you can do here

Read it, share it, quote it and email us. That is the whole site: no accounts, no logins, no forms and nothing to buy.

You may not:

• probe, scan or attack the site or the server behind it;
• try to reach anything that is not published here;
• scrape it in a way that degrades it for other people; or
• use it to break the law.

The writing and the code

The words, design and images here belong to Xcoden. You are welcome to quote a paragraph or two with a link back; ask first before republishing a whole post.

Code in the posts is there to be used. Take it, adapt it, ship it — no attribution required and no license to sign. It comes with no warranty, so read it before you run it.

"Xcoden" and the logo are ours. Other product and company names on this site, such as Shopify, Magento, WordPress and Laravel, belong to their owners, and naming them does not imply any endorsement either way.

Links out

We link to other companies' sites. We do not control them and are not responsible for what is on them. Once you follow a link, their terms apply.

No warranty

The site and everything on it is provided "as is" and "as available", without warranties of any kind, express or implied. We work to keep it accurate and online, but we do not promise it is error-free, current, or reachable at any given moment.

The writing here is general commentary drawn from our own projects. It is not professional, legal, financial or security advice, and it is not tailored to your situation. What you decide to do with it is your call.

Limitation of liability

To the fullest extent the law allows, Xcoden is not liable for indirect, incidental, consequential or punitive damages arising from your use of this site, and our total liability for any claim relating to the site is limited to USD 100. Some jurisdictions do not allow parts of this, in which case it applies as far as it legally can.

Nothing here limits liability for fraud or for anything else that cannot be limited by law.

Privacy

What the site collects, and what it deliberately does not, is set out in the Privacy Policy. The short version: no cookies, no analytics, and the only personal information we hold is what you email us.

Changes

We update these terms when the site changes. The date at the top is the version in force, and using the site after a change means you accept the new version.

Governing law

Illinois law governs these terms, without regard to its conflict-of-laws rules. Any dispute about this site belongs in the state or federal courts in Cook County, Illinois, and we each agree to that venue.

The small print

If any provision here turns out to be unenforceable, the rest stays in force. Not enforcing a term once does not waive it. These terms and the Privacy Policy are the entire agreement between us about this website — not about work we do for you, which your signed agreement covers.
